2 - To whom does this private policy apply?

This private policy applies to all visitors of this website, clients, interested parties, suppliers, service providers, applicants and for all individuals who have received an event invitation by us.

You can generally visit our webpages without telling us your identity, unless

  • You apply to an open position with us or you are subscribed to our job newsletter,

  • You register for one of our events

For that matter, we only process data which is required for replying to your request, your registration, your application or for providing you with our information materials. It is stated in the respective fill-in forms which data is processed. The required data is marked as obligatory. If we ask you for further information in a field, it will be on the basis of voluntary disclosure. We employ this information for individualising or tailoring our offers closer to our clients’ needs.

4 - For which purposes and based on which legal foundation do we employ your data?

We process your private data in accordance with the legal requirements stipulated under the European Union General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG). a) For fulfilling our contractual obligations (Article 6 paragraph 1b GDPR)

Processing private data is conducted to perform a contract as well as for taking steps necessary prior to entering into a contract at your request.

To the extent to which you have given us consent to process private data for specific purposes there are legitimate interests for the processing based on your consent. A given consent can be revoked at any moment. Please consider that the revocation only applies to the future. Processing which has been conducted prior to the revocation is not affected.

  • Providing newsletters: for dispatching newsletters we employ the so-called double opt-in procedure. This means that we only send you an e-mail newsletter once you have explicitly confirmed your consent with receiving the newsletter. With each newsletter you have the opportunity to immediately cancel your subscription.

d) Based on legal requirements (Article 6 paragraph 1c GDPR) or the public interest (Article 6 paragraph 1e GDPR)

Additionally we as a company are subject to a variety of legal obligations (e.g. Federal German Commercial Code, tax laws).

4.1 - Private Policy Directive for Applications

Legal basis for the processing of your private data in this application procedure is primarily paragraph 26 German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG) in the edition which is applicable from 25 May 2018 onwards. According to this Act the processing of data is valid if this data is necessary for determining the reasons for an employment relationship. Should the data be necessary after the completion of the application procedure, e.g. for asserting legal rights, data processing may be conducted on the basis of preconditions of Article 6 GDPR, particularly for realising legitimate interests as defined in Article 6 paragraph 1f GDPR. Then our interest consists of asserting or defending claims.

When you agree with the handling your application by clicking on the button “send” you give your consent that 50Hertz Transmission GmbH may save and process your data for the purposes of the application, staffing and employment. You can revoke this consent at any time with the contact person named in the job ad and withdraw your application.

The personal data which you have filled in in the application form are processed by 50Hertz Transmission GmbH exclusively for the purposes of the application and staffing procedure. Staffing is conducted by the employees in charge in our Human Resources department in cooperation with managers in the specific subject departments.

Your data is deleted six months after the completion of the application procedure. In case of your employment your data is transferred from application-management system into our personal-management-system.

Application using Xing or LinkedIn: Please consider also the private policy requirements of the respective portal when applying via Xing or LinkedIn.

4.2 - Terms of use for the job newsletter

The 50Hertz Transmission GmbH processes your data exclusively for the purpose to send you job advertisements fitting with your favoured categories. To this end we only require your valid E-Mail address and the selection of your favourite categories in our fill-in form. 50Hertz Transmission GmbH cannot guarantee that you always receive the notifications (on time) due to technical reasons. There is no transfer of your personal data to a third party. After dispatching the form you receive a confirmation link by us to the e-mail address stated by you. By clicking on the confirmation link you accept that 50Hertz Transmission GmbH may send you job advertisements confirming to your selected categories until you withdraw your consent by e-mail. With each of these e-mails by 50Hertz Transmission GmbH you receive a link which enables you to terminate the dispatch and to execute your right to object. Your personal data will then be completely deleted from our mailing list. For all further questions on data protection with 50Hertz Transmission GmbH our data protection officer is also at your disposal at any time (address stated below).

5 - Who receives my data?

Within 50Hertz Transmission GmbH your data is accessed by the respective points which need your data to fulfil our contractual and legal obligations or in the framework of balancing interests. Service providers and auxiliary persons employed by us may also receive data to these purposes if they adhere to confidentiality and our privacy policy. A transfer to third parties only takes place in accordance with the framework of the regulations set by GDPR and BDSG.

6 - Is data transferred to a third Country?

There is no data transfer to countries outside of the European Union i.e. the European Economic Area (so-called third countries).

7 - How long is my data recorded?

We process and record your personal data as long as it is necessary for fulfilling our contractual and legal obligations or required in the framework of balancing interests. If the data is no longer needed for fulfilling these purposes, it is regularly deleted, unless their – limited – processing is necessary to comply with storage periods prescribed by commercial and tax law, e.g. German Commercial Code and General Fiscal Law. The periods for storage i.e. record keeping stipulated in these legal texts are six to ten years.

Regarding applications data on rejected applicants is deleted six months after completion of the application procedure. If you exercise your right to object in the job newsletter or in the general newsletter, your personal data will be completely deleted from our mailing list.

8 – Which rights do I derive from the privacy policy?

You have the right of access to information in accordance with Article 15 GDPR, the right to rectification in Article 16 GDPR, the right to erasure in Article 17 GDPR, the right to restriction of processing in Article 18 GDPR, the right to object in Article 21 GDPR and the right to data portability in Article 20 GDPR. Moreover, there is a right to lodge a complaint with a supervisory authority (Article 77 GDPR in conjunction with paragraph 19 BDSG). 9 – Is there a duty to provide data?

In the framework of our business relationship, in application procedures or the order of services, you must provide the respective personal data (marked mandatory fields) which are necessary for performing the business relationship, application procedure or the provision of services and the compliance with the contractual obligations connected or which we must collect by law. Without this data we generally must reject the conclusion of a contract or the provision of a mandate or cannot perform an existing contract and must, if applicable, terminate it.

10 – Is there an automatic decision-making including profiling?

As a matter of principle, we do not employ automatic decision-making including profiling in accordance with Article 22 GDPR.

11 – Information about your right to object in accordance with Article 21 GDPR

a) Individual right to object

You have the right to object against the processing of your private data for reasons which are founded in your personal situation. It is a precondition that the data processing is conducted based on public interest or a balancing of interest. This also applies to profiling. In case of an objection we will no longer process your private data, unless we can establish compelling legitimate grounds for the processing which override your interests, rights and freedoms. Or if your private data serves the assertion, exercise or defence of legal claims.

b) Objection against processing your data for direct marketing

In isolated cases we use your personal data for our direct marketing. You have the right to object to this at any time; this includes profiling if it is connected to direct marketing. In the case of an objection we do no longer process your private data for these purposes. The objection can be exercised without following any particular form and should, ideally, be transmitted to our external data protection officer whose contact details are stated above.

12 – Which data is processed during the retrieval of the website?

a) User-related data

We receive user-data when our Internet sites are retrieved. This includes indications such as e.g. used monitor resolution, browser edition, internet access, operating system, language, plugins installed, origin by country/region and to search engines. The data saved is only processed for statistic purposes and for optimising our websites. A transfer to third parties and a user-related analysis does not take place. Moreover, we save connection data to our websites (IP addresses) for a short period of a few days in order to guarantee IT security.

b) Application of cookies

By retrieving single pages so-called session cookies are applied in order to facilitate navigation. These temporary cookies expire after the session ends and do not contain any private data i.e. the content of the cookies are not evaluated user-related. You can change the settings of your browser to allow cookies only in particular cases or not at all.

Cookies which are required to conduct the electronic communication process or to provide particular functions are saved on the basis of Article 6 paragraph 1f GDPR. In this case cookies are saved for the purpose of providing our services without technical errors and in an optimised manner. 13 – How secure is my data?

50Hertz Transmission GmbH protects your data by technical and organisational measures from unauthorised access, loss and destruction. On principle, a transfer of personal data by 50Hertz Transmission GmbH does only take place in encrypted form.

14 – Which plugins and tools are employed on our website?

a) Social plugins

Our Internet sites can contain so-called Social Plugins (“plugins”) from social networks facebook.com, twitter.com, xing.com, linkedin.com, pinterest.com, addthis.com, reddit.com and plus.google.com. In order to increase the protection of your data during a visit on our website, plugins are integrated by means of so-called “two click” or “sheriff” solutions into the site. This integration ensures that retrieving a website which contains those plugins does not establish access to the servers of Facebook, Twitter, Xing, linkedin, pinterest, addthis, reddit and Google +. Only if you activate the plugins and, thus, consent with the data transfer, your browser establishes a direct connection to the servers of Facebook, Twitter, Xing, Linkedin, pinterest, addthis, reddit and Google +. The content of the respective plugin is directly transmitted to your browser and integrated into the page. The plugin transfers data (including your IP address) to the operator of the social networks enumerated. We have no influence on the data volume which social networks gather using plugins.
To the best of our knowledge Facebook, Twitter, Xing, linkedin, pinterest, addthis, reddit and Google+ receive information on the websites which you have retrieved before and during your visit. By retrieving plugins Facebook, Twitter, Xing, linkedin, pinterest, addthis, reddit and Google+ receive the information that your browser is retrieving the respective page on our website even if you do not have a profile with the respective social network or if you are not currently logged in. This information (including your IP address) are directly transferred from your browser to the operating servers of Facebook, Twitter, Xing, linkedin, pinterest, addthis, reddit and Google+ in the US and stored there. With Xing data is stored in Germany. The information is possibly published in the respective social networks and will be shown to your contacts.

b) Google Analytics

We employ google analytics on our websites, a web analysis service provded by Google Inc. (“Google”). Google uses cookies. The information which a cookie generates about the usage of the online offer by a user are generally transmitted to a server of google in the US and stored there. Google will use this information on our behalf to evaluate the usage of our online offers by users, to make reports about activities within this online offer and to provide for us other services which are connected to using this online offer and internet usage. Thus, pseudonymised user profiles may be generated from the processed user data.

We use Google Analytics only with activated IP anonymization. This means that the IP address of users is shortened by google within the European Union Member States or other States to the European Economic Area. Only in exceptional cases the full-lengthened IP address is transmitted to a server of google in the US and shortened there. The IP address from the browser of the user will not be merged with other data from google. Users can avoid the storage of cookies by a specific setting in their browser software. Additionally, the transfer of data generated by the cookie with regards to the usage of the online offer as well as the processing of this data by google can be avoided if you download and install the browser plugin available here: http://tools.google.com/dlpage/gaoptout?hl=d

c) YouTube

Our website uses plugins by YouTube which is operated by google. Operator of these pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. If you visit one of our pages carrying YouTube-plugins a connection to the servers of YouTube will be generated. Thus, the YouTube server is told which 50Hertz page you have visited. If you are logged in with your YouTube-Account, you enable YouTube to directly attribute your surfing conduct to your personal profile. You can avoid this by logging out from your YouTube Account.
