The enforcement of incentive regulation based on the Ordinance on incentive regulation of energy supply systems dated 29 October 2007 (Incentive Regulation Ordinance – ARegV) (Federal Gazette 2007, Part I, No. 55, issued in Bonn on 05 November 2007) has done away with the necessity to submit an application for approval of grid access charges.
By virtue of its decision of 17 March 2009, the German regulator Bundesnetzagentur defined a revenue cap for 50Hertz after having carried out a consultation procedure. It is on the basis of this revenue cap that 50Hertz determines the prices for grid use.
During a given regulatory period, 50Hertz is entitled to perform adjustments to the revenue cap in accordance with statutory provisions and instructions from the regulator.
